The arbitration agreement, sometimes dubbed the "champagne clause" for its last-minute inclusion in contracts, often lacks the attention it truly deserves. A poorly drafted arbitration clause can severely undermine your ability to enforce contractual rights. Without a clear and effective dispute resolution mechanism, the contract risks being rendered ineffective, no matter its terms on paper.
In this knowledge session on 8 October, Jakob Ragnwaldh, partner at Mannheimer Swartling in Singapore, will discuss the essential do's and don'ts when drafting and negotiating an effective arbitration clause, including the seat of arbitration, arbitration rules, arbitral institutions, enforceability and other strategic considerations.
